We're sure that by now everyone is aware that from 1st October virtually all sports nutrition products will liable to VAT. Previously most powdered products - e.g. protein powders such as whey, mass gainers, pre workout powders etc.. - have been zero rated for VAT purposes as they were previously classified as food. This new ruling moves sports nutrition drinks (even in powdered form) to the classification of being beverages, and therefore standard rated at 20% for VAT.
So how does this affect you, our customers, consumers of sports nutrition that you are? Basically it means that retailers like us have to add 20% to our sales prices. Of course we dont get any benefit from this price hike, we effectively act as tax collectors - we take the 20% that you pay us and then have to pay it on to the government. So does this mean that all of our prices on sports nutrition powders will go up by 20%? Approximately yes, but there's sure to be some movement on prices as us and other retailers jostle to remain as competitive as possible. With rising buying costs, rising delivery costs (which retailers like us absorb entirely by offering free shipping), and already very slim margins on most of these products, there's not going to be a massive amount that we and other retailers can do to take some of the 20% hit ourselves so you should expect to be paying 15-20% more for your whey protein from October 1st .
All retailers are of course opposed to this new tax because no one likes putting their prices up as it a) reduces demand and b) loses custom/sales/profit. Unfortunately our tiny sports nutrition industry is the least of the government's concerns so despite some valiant efforts the new ruling couldnt be stopped.
Anyhow, the bottom line is that with a 15-20% price hike from October 1st, it makes sense to stock up before the increase comes into force. We are currently offering reduced prices on many of our protein powders, weight gainers and pre-workouts. On top of this if you spend over £100 you get an automatic 5% extra discount. We know that times are tough, but if you have the money available then now is the time to buy a little more than you need so that you save money later on.

Why have the government brought in this new rule?
This ruling was part of a group of rulings on VAT intended to close 'loopholes' where there were certain ambiguities over what is VATable and what isnt. Before the change for instance pre-mixed sports nutrition drinks (e.g. in liquid form) were considered standard rated whilst powders were zero rated. Certain powders, such as aminos like glutamine and branched chain aminos were standard rated. Creatine was the subject of much debate, the official documentation suggested it should be standard rated but it was commonly accepted to zero rate it. On top of this some unscrupulous companies would abuse this uncertainty by not charging VAT (or worse charging it but not declaring it) on products that they knew they should have, All added together, its hardly suprising that once sports nutrition grew from a tiny niche industry to the substantial size it has become that at some point the government would spot these issues and look to close these loopholes, whilst simultaneously looking for a way to increase their own revenue (particularly in a time when the country is in recession and there is a big deficit to try and recover). The result - they've declared all sports nutrition drinks subject to VAT.
Is it fair that they have done this?
Not really, in our opinion. Maybe things like pre-workout powders and aminos we can understand, but whey protein, MRPs and mass gainers are food and should be treated as such. They are primarily used as food substitutes both by bodybuilders and non bodybuilders. There's also the point of view that this can be seen as a tax on a healthy food source, while many very poor quality foods remain untaxed. An argument can be made for special interests - the junk and convenience food industries have a lot more weight in parliament than we do. This was evidenced by the fact that the 'pasty tax', which was due to be introduced at the same time as this increase on sports nutrition, was scrapped completely after lobbying by the large companies who sell the affected items, backed by national newspaper campaigns. Of course, not only did that campaign have bigger companies supporting it than our own industry's did, but a much larger portion of the population cared about that particular proposed tax increase.
What exactly do the new rules say?
'Sports drinks that are advertised or marketed as products designed to enhance physical performance, accelerate recovery after exercise or build bulk, and other similar drinks, including (in either case) syrups, concentrates, essences, powders, crystals or other products for the preparation of such drinks'.
So the new ruling is actually quite specific on its how the product is marketed that determines whether it is standard rated or not. At first we all thought this may mean that if we simply change the marketing on the products, we could continue to zero rate some items. However, the government are slightly smarter than that and take into account not only the marketing text used but where the product is marketed, how its marketed, who to, where it is sold, the packaging etc.. So its not as simple as just changing the label and avoiding the tax. Although we are sure some brands will 'test the water' on this.
Will any products escape this increase?
Yes - slimmers' drinks. Slimmers you say? They are overweight middle aged ladies in cardigans arent they? Well maybe not, maybe you should consider becoming a slimmer yourself, tough guy... Probably to appease a couple of big companies who make the awful shakes in a can that said-middle-aged-ladies gobble up in supermarkets, 'slimmer's drinks' will remain zero rated and exempt from this tax. Now this opens up a whole new loophole. What exactly is a slimmer's drink? The technical description is that its any such product designed to promote weight loss. At the moment, unless the government tidies this up later on, diet whey products like PHD Diet Whey, Sci MX Diet Shake and Reflex Diet Protein would seem to qualify as slimmer's drinks and the brands currently intend to keep these products zero rated. Now this is a very grey area and arguments can be made either way, but for now it means that your favourite companies do have the option of keeping diet whey proteins VAT free. And you can bet that every company that doesnt make a diet whey will be doing so very soon! A smart move as these will most likely be the cheapest whey proteins available. There's also a case for MRPs (meal replacement powders) being classified as slimmers drinks, so some of these may also remain zero rated - especially with a little shift in marketing.
Is there some kind of conspiracy going on?
Whilst it may seem far fetched, it could be time to get the tinfoil hats out. It certainly does seem like there's a lot of anti-sports nutrition rulings and sentiment at the moment. We have the VAT increase, the MHRA banning products left right and center, TV programs such as the recent Panorama show 'the truth about sports products', and a bizarre increase in articles (mostly negative) on protein powders and other supplements appearing in the tabloids. It all seems a little co-ordinated for our liking. All we need now is a sports nutrition equivalent of 'Reefer Madness' to be made (Reefer Madness was a politically motivated anti-marijuana movie, made and promoted with the intention of killing the hemp industry in the 1930s in order to further the interests of bigger industries like the pharmaceutical, paper, alcohol and oil industries who didnt want to compete with hemp for its possible uses as medicine, paper, fuel etc..).
If you made it this far, well done for your impressive attention span for one thing. For a second, hopefully you now have a greater understanding of this new ruling and its implications. Its not good for us, its not good for you, its quite good for the VAT man, but its one of those things we just have to swallow and deal with. As of tomorrow - 25th July 2012 - we will be sending all of our UK mainland deliveries on a next day tariff. We've been trialing DPD as our new couriers for the past month and found their next day service to be excellent, but the slower 2-3 day service (which is actually sent via Hermes) to be far less reliable. So we negotiated a lower rate for our next day tariff and have agreed that all UK orders (except offland locations) will go on the next day rate.
An added bonus of us using DPD is that their next day parcels come with a service where they will text or email our customers with a one hour delivery timeslot. You can then change this time if its not convenient, and it saves you from having to wait in all day unsure of when the delivery will come - which is surely a pet peeve for a great many online purchasors.
All of our offland UK deliveries will still be sent on a 2 working day tariff as the next day tariff is currently cost prohibitive to these locations.

We're hoping to bring you some useful articles on training here on our blog. Today we're focusing on an area that is a weak point for many - the hamstrings. The hamstrings are sometimes known as the biceps of the leg. However they are much larger but get far less attention than their arm counterparts.
Good hamstring development is not just for bodybuilders - participants in a wide variety of sporting disciplines can benefit from improved hamstring size and strength. One sport in particular is brazilian jiu jitsu/submission grappling where strong hamstrings are important for the optimal application of certain submissions (e.g. armbars, triangle chokes) and for explosive bridging movements to escape pin positions. As a grappler myself, I asked our sponsored athlete John Berry for a routine to help encourage hypertrophy in this important body part and here is his suggested routine:
- Hamstring Curls (seated or Lying) 5-7 sets x 15-20 reps with a focus on contractions. On the last 2 sets stretch the hamstring/fascia for 30 seconds. 45 seconds max rest between sets.
- Long Step Lunges with push back to starting postion 3 set x 15 reps on each leg. Squeeze hamstring on the push back to start.
- High Weighted Step Ups 3 sets to failure
- Stiff Leg Deadlifts 3 sets of 8-12 reps
- Heavy Walking Dumbbell Lunges 2 sets to failure or min of 30 steps

For those of you that dont know, we have been operating since October 2009 but previously have only been working as wholesalers selling to gyms, stores and other distributors. We have been the official UK importers for AST Sports Science, Allmax Nutrition, Fusion Bodybuilding, Nutrabolics and several others.
So who are Dynamic Sports Nutrition?
Dynamic Sports Nutrition are run by the team who founded and operated BodyShapers Fitness Ltd from 2003 to 2009. We sold that company in 2009 and were bound by a 3 year non compete deal. In the time since, we have been importing and wholesaling some great US and Canadian brands but now we are back to operating without restriction and are able to offer our great pricing and service once again to consumers.
What will Dynamic Sports be offering?
